Our mission is to design and operate an unmatched collection of resorts and casinos and provide unsurpassed service and amenities to our guests. We hope that you enjoy our luxurious facilities, our exciting entertainment, and our quality customer service, and that you visit us again. Because we value your patronage and respect your privacy rights, we are voluntarily providing you with this statement of our Privacy Policy.

This Privacy Policy applies to Personal Information (as defined below) collected by MGM MIRAGE at the MGM MIRAGE resorts and casinos and the MGM MIRAGE Web Sites. Users of the MGM MIRAGE Web Sites are also referred to the Terms of Use for the MGM MIRAGE Web Sites, located at https://www.mgmmirage.com/TermsOfUse.htm.

A Special Notice about Children Children [persons under the age of twenty-one (21)] are not permitted to gamble in casinos, loiter in the gaming areas, or drink alcoholic beverages at any of the MGM MIRAGE resorts and casinos. In addition, children may not be permitted to attend certain entertainment or enter into contractual relationships with MGM MIRAGE in certain states. If you are under the age of 21, we ask that you do not gamble or loiter in the gaming areas, drink alcoholic beverages, attend inappropriate entertainment, or enter into contracts that you are not legally permitted to enter, and that you do not provide any Personal Information to us.

I. Personal Information We Collect About You "Personal Information" is information through which you can be identified. Personal Information that MGM MIRAGE may collect from you directly or through Strategic Partners (see below), includes but is not limited to your name, date of birth, postal address(es), e-mail address(es), telephone number(s), fax number, gender, credit card information, Driver’s License Number and State, Social Security Number, Passport information, Naturalization information, purchase and reservation information, gaming activity, and other information that you voluntarily provide; it may also include live video feed if you visit our public entertainment facilities. When you complete a marker play application, MGM MIRAGE may also collect the name of your firm, your firm's address and telephone number, your position with the firm, your social security number, and banking information (including the name and address of your primary and secondary banks and your account numbers). This Personal Information is collected by e-mail, through mail-in forms, through online and on-site applications you complete, and through your activities with MGM MIRAGE. MGM MIRAGE only collects Personal Information that you voluntarily provide to us or voluntarily provide to Strategic Partners who share that information with us. The Personal Information that MGM MIRAGE collects through the MGM MIRAGE resorts and casinos, through the MGM MIRAGE Web Sites, or obtains from its Strategic Partners depends on the nature of your activities, including, but not limited to whether you make reservations, sign the guestbook, apply to become a member of Players Club, apply for a job, purchase show tickets or merchandise, register to receive promotional information, complete a casino patron application, play games, plan a meeting, etc.

General Information “General Information” is information about you or your activities through which you cannot be identified. When you use the Internet, your web browser or client software may transmit certain information to the servers that host the web sites you visit. The information may include the unique number assigned to your server or Internet connection, the capabilities and features of your computer, your geographic location, and your movement within and interaction with the web site including what pages you look at and what information you download. When you visit MGM MIRAGE Web Sites, MGM MIRAGE servers collect such general information. MGM MIRAGE uses this general information to generate aggregate statistics about visitors to MGM MIRAGE Web Sites. In situations where it is possible to do so, General Information may be linked to Personal Information. Cookies MGM MIRAGE Web Sites use cookie technology. A cookie is a small file that contains information sent by a web site that is saved on your hard disk by your computer's browser. Cookies store information that a web site may need to personalize your experience and to gather web site statistical data, such as which pages you visit, what material you download, your internet provider's domain name and country, and the addresses of web sites you visited immediately before, and after, visiting a particular web site. MGM MIRAGE Web Sites use cookies to collect and store your preferences for viewing the MGM MIRAGE Web Sites, such as whether you disable Flash so that you will not have to do so on follow up visits.

In addition, MGM MIRAGE Web Sites use cookies to provide a unique identifier to your computer so that we can generate statistics regarding usage of MGM MIRAGE Web Sites, such as the percentage of repeat visitors and other general statistics. In situations where MGM MIRAGE has Personal Information, the unique identifiers may be matched with Personal Information. In addition, when you book a reservation online to stay at an MGM MIRAGE resort, the reservation or confirmation number may be stored in a cookie on your computer and in an order file generated by Strategic Partners.

To browse the Internet and MGM MIRAGE Web Sites without cookies, you can configure your browser to reject all cookies or to notify you when each cookie is offered so that you can accept or reject each cookie. You may not be able to conduct some transactions or use some services on MGM MIRAGE Web Sites if you disable your browser from accepting cookies.

II. How We Use The Information We Collect Certain transactions and services offered while visiting MGM MIRAGE may be processed or provided by Strategic Partners (collectively, "Strategic Partners") under contract with MGM MIRAGE, even though it may appear that you may not have left the MGM MIRAGE Web Sites or the MGM MIRAGE resorts and casinos. Personal Information and General Information obtained by MGM MIRAGE may be shared with Strategic Partners who are under an obligation to MGM MIRAGE to use reasonable care to keep Personal Information confidential. Personal Information and General Information obtained by Strategic Partners may be shared with MGM MIRAGE, which will use such General Information and Personal Information in accordance with the terms of this Privacy Policy. MGM MIRAGE and its Strategic Partners may use the information collected by us or our Strategic Partners: (1) to respond to your inquiries; (2) for marketing purposes, including, but not limited to, notifying you of special promotions, offers and events (including promotions and offers through our Strategic Partners), additionally, live video feed from visitors to our public entertainment facilities may be used to promote these facilities on the MGM MIRAGE Web Sites; (3) to process and fulfill reservations and make a record of reservations; (4) to process and fulfill purchases and make a record of purchases; (5) to enable us to contact you for confirmation or customer service after reservations and purchases are made or after you sign up for or participate in certain activities; (6) to respond to inquiries, complaints and other communications; (7) to cross-reference with other Personal Information that we have acquired about you or may acquire about you through other sources; (8) to notify our Strategic Partners (including affiliated resorts and casinos not covered by this Privacy Policy) in the event you enroll in MGM MIRAGE’s Responsible Gaming Program (see A Special Note about Personal Information and MGM MIRAGE’s Responsible Gaming Program below); (9) for profiling or demographic purposes; and (10) for purposes of tracking reservations and corresponding hotel stays generated through MGM MIRAGE’s affiliate program and calculating and auditing commissions that may be paid in relation to the hotel stay.

MGM MIRAGE reserves the right to transfer your Personal Information to a third party in the event of a transfer of all or substantially all of MGM MIRAGE’s assets to a third party, provided that the third party agrees to adhere to the terms of this Privacy Policy. Likewise, each MGM MIRAGE resort and casino reserves the right to transfer your Personal Information relevant to that resort and casino to a third party in the event of a transfer of all or substantially all of that MGM MIRAGE resort and casino’s assets to a third party, provided that the third party agrees to adhere to the terms of this Privacy Policy.

This Privacy Policy does not apply to information collected by Strategic Partners, except that MGM MIRAGE will treat information it receives about you from Strategic Partners in accordance with the terms of this Privacy Policy. MGM MIRAGE does not have any control over how Strategic Partners use information they collect about you, except that MGM MIRAGE has obligated its Strategic Partners to use reasonable care to keep confidential the Personal Information they receive from MGM MIRAGE. A Special Note about Personal Information and MGM MIRAGE’s Responsible Gaming Program: MGM MIRAGE believes that gaming should always be handled responsibly. That’s why MGM MIRAGE is a member of the American Gaming Association and adheres to the American Gaming Association Code of Conduct for Responsible Gaming. As part of MGM MIRAGE’s Responsible Gaming Program, MGM MIRAGE will not use Personal Information of members of the MGM MIRAGE’s Self-Limit Access Program of Nevada, Self-Exclusion Program of Mississippi, or Disassociated Persons Program of Michigan, for any marketing purposes, including but not limited to the following marketing; direct mail marketing, telemarketing, promotional mail, and player recognition programs.

A Special Note about MGM MIRAGE Voice Message Board: MGM MIRAGE Voice features a message board for employees of MGM MIRAGE who volunteer their time in various charitable enterprises. Although the ability to post to this message board is restricted, password protected, for employees only, and subject to a separate privacy policy, postings to this message board, including employee login names, will be made available for viewing at an unsecured, unrestricted web page within the MGM MIRAGE Voice web site.

III. Disclosure Of Information We Collect Except as provided in this Privacy Policy (see “How We Use Your Personal Information” above), MGM MIRAGE will not sell, trade, or disclose to third parties any Personal Information obtained through MGM MIRAGE or obtained from Strategic Partners, without your consent. MGM MIRAGE may disclose Personal Information: (1) to comply with a court order, subpoena, search warrant or other legal process; (2) to comply with legal, regulatory or administrative requirements of any governmental authorities; (3) to protect and defend MGM MIRAGE, its subsidiaries and affiliates, and all of their officers, directors, employees, attorneys, agents, contractors, and partners, in connection with any legal action, claim or dispute; (4) to enforce the terms of use of MGM MIRAGE Web Sites; (5) to prevent imminent physical harm; (6) to businesses that MGM MIRAGE may use for purposes of performing functions on behalf of MGM MIRAGE, such as companies that process credit card transactions; (7) in connection with the sale, assignment, or transfer of any MGM MIRAGE resort and casino or MGM MIRAGE Web Site; and (8) to Strategic Partners and affiliates of MGM MIRAGE for purposes of tracking reservations and corresponding hotel stays generated through MGM MIRAGE's affiliate program managed by Strategic Partners and calculating and auditing commissions that may be paid in relation to the hotel stay.

VI. Security General Information and Personal Information collected by MGM MIRAGE is stored on secure servers. The secure servers are protected by firewalls and other standard security procedures. The secure servers are not generally accessible by unauthorized third parties, but could become accessible in the event of a security breach. No security system is impenetrable. At MGM MIRAGE, our staff is required to take reasonable measures to ensure that unauthorized third parties do not view your Personal Information.

MGM MIRAGE has no control over the security of the computers or other electronic devices and means you use to send e-mails and submit information to MGM MIRAGE over the Internet. Therefore, MGM MIRAGE is not responsible for the disclosure or interception of your information before MGM MIRAGE receives it.

VII. Changes to this Privacy Policy This Privacy Policy was last revised on May 24, 2006. MGM MIRAGE reserves the right to change, modify or amend this Privacy Policy at any time without notice. When the Privacy Policy is changed, modified and/or amended, the revised Privacy Policy will be available at MGM MIRAGE resorts and casinos and will be posted on the MGM MIRAGE Web Sites. Any revised Privacy Policy will only apply prospectively to Personal Information collected or modified after the effective date of the revised policy. Customers are responsible for periodically checking the Privacy Policy available at MGM MIRAGE resorts and casinos and the MGM MIRAGE Web Sites for changes, and are encouraged to bookmark the Web Sites to check for updates and take or print out copies of the Privacy Policy for their records.
